Welcome to Heart2Home Living (“we”, “us” or “our”).

By accessing our website, creating an account, placing an order or purchasing from us, you agree to these Terms & Conditions together with our Returns & Exchanges Policy, Shipping & Collection Policy and Privacy Policy.

These Terms apply to purchases made online, through Click & Collect and, where relevant, from our Heidelberg West warehouse.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law (ACL).

1. Products & Clearance Stock

Heart2Home Living offers homewares and home décor, including designer brands, clearance products, discontinued lines, end-of-line products and limited-stock collections.

Much of our stock is clearance, discontinued, end-of-line or limited quantity. Availability can therefore change quickly and products may not be restocked once sold out.

We make reasonable efforts to accurately represent our products, including photographs, colours, finishes, dimensions and descriptions. However, minor variations may occur due to lighting, photography, screen displays, manufacturing variations or measurement methods.

Some clearance products may have minor imperfections. Where a particular fault or imperfection is disclosed before purchase, that disclosed condition forms part of the product information. This does not affect any other rights you may have under Australian Consumer Law.

2. Pricing

All prices are displayed in Australian dollars (AUD) and include GST where applicable.

Prices, promotions and product availability may change without notice.

Online prices may occasionally differ from warehouse-event prices or other promotional pricing due to special offers, clearance events or limited-time promotions.

If an obvious pricing, product-description or system error occurs, we reserve the right to correct the error and, where necessary, cancel the affected order.

If we cancel an order after payment has been received, the applicable amount will be refunded.

3. Orders & Payments

Placing an order does not guarantee acceptance until the order has been successfully processed and confirmed.

Orders are subject to stock availability and successful payment.

We reserve the right to cancel or limit an order where:

stock is unavailable;
incorrect pricing or product information has been displayed;
payment cannot be processed or authorised;
unusually large quantities have been ordered; or
we reasonably suspect fraudulent, unauthorised or improper activity.

If we cancel an order after payment has been received, the applicable amount will be refunded.

Customers are responsible for providing accurate and complete contact, billing, delivery and collection information.

4. Online, Warehouse & Click & Collect Purchases

Not all Heart2Home Living products are available through the same purchasing or fulfilment methods.

Some products may be available for online purchase and delivery, while others may be designated Click & Collect Only or In-store Only due to their size, weight, fragility, clearance status or limited availability.

The purchasing and fulfilment options displayed for a product or at checkout will apply to that order.

Click & Collect customers will be notified when their order is ready.

Please do not travel to the warehouse until you have received confirmation that your order is ready for collection.

5. Clearance Items, Returns & Exchanges

Please choose carefully when purchasing clearance products.

We generally do not provide refunds, exchanges or store credits for change of mind on clearance purchases, except where otherwise stated by us or required by law.

A change of mind includes circumstances where you:

decide you no longer want the product;
select the wrong colour, size or style;
find the product unsuitable after purchase; or
find the same or a similar product elsewhere at a different price.

Clearance status does not remove your rights under Australian Consumer Law.

If a product fails to meet an applicable consumer guarantee, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances and applicable law.

Where a particular fault or imperfection was clearly disclosed before purchase, your rights in relation to that specific disclosed condition may differ. This does not affect your rights regarding other faults or problems.

6. Shipping & Collection

Shipping is available only for eligible products and delivery locations.

Some bulky, heavy, fragile or warehouse-only products may not be eligible for shipping and may instead be offered through Click & Collect or in-store purchase only.

Shipping charges and available delivery methods will be displayed where applicable before checkout is completed.

Delivery timeframes are estimates and may be affected by circumstances outside our reasonable control.

7. Product Availability

Our clearance and limited-stock business model means products may sell quickly.

Although we make reasonable efforts to maintain accurate inventory information, an item displayed as available online may occasionally become unavailable before an order is processed.

If we are unable to fulfil an item you have paid for, we will contact you and provide an appropriate refund for the unavailable item.

An identical replacement may not always be available because many of our products are clearance, discontinued or limited stock.

8. Website Information

We aim to keep product descriptions, photographs, pricing, availability and other website information accurate and current.

However, occasional errors, inaccuracies or omissions may occur.

We reserve the right to correct errors, update information, change prices and discontinue products where appropriate.

Nothing in this section limits any rights or remedies available under Australian Consumer Law.

9. Customer Accounts

Where customer accounts are available, customers are responsible for providing accurate information and maintaining the confidentiality and security of their account details.

You are responsible for activity conducted through your account unless otherwise required by law.

We may suspend or restrict an account where we reasonably believe it is being used fraudulently, improperly or in breach of these Terms.

10. Website Use

You must not use this website:

for any unlawful or fraudulent purpose;
to interfere with the website's operation or security;
to introduce viruses, malware or other harmful code;
to attempt unauthorised access to our systems or customer information;
to improperly collect or extract information from our website;
to impersonate another person or provide deliberately false information; or
to infringe our intellectual property rights or the rights of another party.

We reserve the right to restrict access to our website where reasonably necessary to protect our customers, website or business.

11. Third-Party Services

Our website is hosted using Shopify and may use third-party providers for payment processing, delivery, applications and other website functionality.

Certain services may therefore be subject to the relevant third-party provider's terms, conditions and privacy practices.

Our website may also contain links to external websites. Heart2Home Living is not responsible for the content, availability or privacy practices of third-party websites that we do not control.

12. Intellectual Property

Unless otherwise stated, the Heart2Home Living name, branding, website content, original photographs, graphics, text and other original materials are owned by or licensed to Heart2Home Living.

Our content may not be copied, reproduced, republished, distributed or commercially used without permission, except where permitted by law.

Heart2Home Living also stocks and sells products from third-party designers, manufacturers and brands.

Third-party brand names, logos, product designs and trademarks displayed on our website remain the property of their respective owners. Their appearance on our website does not imply ownership by Heart2Home Living.

13. Privacy

Personal information submitted through our website is handled in accordance with our Privacy Policy and applicable Australian privacy requirements.

This may include information provided when creating an account, placing an order, joining our mailing list, submitting an enquiry or contacting us.

14. Liability

To the maximum extent permitted by law, Heart2Home Living will not be liable for indirect or consequential loss arising from the use of our website or products where such liability may lawfully be excluded.

Nothing in these Terms is intended to exclude, restrict or modify any consumer guarantee, right or remedy available under Australian Consumer Law that cannot lawfully be excluded, restricted or modified.

15. Changes to These Terms

We may update these Terms & Conditions from time to time to reflect changes to our products, services, website, business practices or legal requirements.

The current version will be published on our website together with the applicable update date.

Your continued use of the website after changes are published constitutes acceptance of the revised Terms to the extent permitted by law.
